1. ACCEPTANCE OF THE TERMS OF USE

These Terms of Use are intended to define the terms and conditions under which MinePiece provides its Services to the User.

Use of at least one of the services offered by MinePiece by the User constitutes full and complete acceptance of the Terms of Use described below. Additionally, the User agrees to comply with the rules and regulations governing shared spaces between Users within MinePiece. MinePiece reserves the right to unilaterally modify the content of these Terms of Use at any time; the User is therefore encouraged to refer to them as often as possible to stay informed. These texts are available at any time directly on the site https://minepiece.net/.

If the User does not accept these Terms of Use, they must refrain from accessing the Services offered by MinePiece.

2. AVAILABILITY AND DESCRIPTION OF THE SERVICES PROVIDED

The Services offered by MinePiece are freely accessible from anywhere to any User with internet access. All costs incurred by the User to access the Services (computer equipment, software, internet connection, etc.) are at their own expense. These Services are normally accessible at all times (24/7); however, access may be interrupted, suspended, or modified without notice for maintenance or other reasons (MinePiece will endeavor to communicate such interruptions in advance). MinePiece is not responsible for these interruptions (intentional or not) or their consequences for the User. MinePiece reserves the right to deny any User access to all or part of the Services unilaterally and without prior notice, especially in cases of clear violation of these Terms of Use. The User acknowledges that MinePiece shall not be liable for any direct or indirect damage resulting from the revocation of access to the Services. Access to the Services is free, open, and without purchase obligation.

The website https://minepiece.net/ aims to provide information concerning the entire MinePiece platform and strives for accuracy. However, MinePiece cannot be held responsible for omissions, inaccuracies, or failures to update, whether caused by itself or third-party partners. All information indicated on https://minepiece.net/ is given for reference only and is subject to change. Furthermore, the information provided is not exhaustive and may have been modified since its initial publication.

3. LIMITATION OF LIABILITY

MinePiece cannot be held responsible for direct or indirect damage caused to the User’s equipment during access to MinePiece’s Services resulting from outdated hardware, viruses, or outdated browsers, or from bugs or incompatibility issues.

The use of the Services is at the User's own risk, especially regarding the downloading of data, files, or software that may damage the User’s device. MinePiece is not liable for any loss of data, viruses, bugs, or damage affecting the User’s equipment and/or personal data.

MinePiece’s Services are governed by French law. Interactive spaces are available to Users, and MinePiece reserves the right to remove, without prior notice, any Content that violates applicable French laws. In such cases, MinePiece may also hold the User civilly and/or criminally liable, especially for racist, offensive, defamatory, or pornographic messages, regardless of the medium used (text, photo, etc.).

MinePiece’s Services may contain hyperlinks* to other websites, authorized by MinePiece. However, MinePiece cannot verify the content of these sites and therefore accepts no responsibility for them. The User agrees not to hold MinePiece liable for content and resources from external hyperlinks.

Browsing the site https://minepiece.net/ may result in the installation of cookie(s)* on the User’s computer. Refusing cookies may lead to an inability to access certain services. However, the User may configure their browser to block cookies.

MinePiece does not guarantee that the Services meet the User’s expectations. MinePiece is not responsible for any data shared by the User in violation of third-party rights. MinePiece shall not be liable for direct or indirect damages such as financial loss, loss of income, or other problems resulting from the use or inability to use the Services.

4. INTELLECTUAL PROPERTY AND INFRINGEMENT

The User acknowledges that MinePiece, along with Mojang, is the sole owner of the Intellectual Property Rights* used across all Services. Nothing in these Terms of Use shall be construed as granting the User a license to such Intellectual Property Rights, owned or exclusively exploited by MinePiece.

MinePiece only grants permission for personal and private viewing of its Content, excluding any public viewing or distribution. Any unauthorized representation, reproduction, or extraction of the Content or any other Intellectual Property Right is strictly prohibited and subject to legal action. Offenders may face civil and criminal penalties, including those provided in articles L.335.2 and L.343.1 of the French Intellectual Property Code.

5. PERSONAL DATA MANAGEMENT*

In France, personal data is protected by law No. 78-87 of January 6, 1978, law No. 2004-801 of August 6, 2004, article L. 226-13 of the Penal Code, and the European Directive of October 24, 1995.

MinePiece collects personal information from the User only as needed for specific services offered on https://minepiece.net/. The User knowingly provides this information, particularly when entering it themselves. It is specified whether the information is mandatory or optional.

According to articles 38 and following of law 78-17 of January 6, 1978 on data processing and privacy, any User has the right to access, rectify, and oppose their personal data by sending a signed written request, accompanied by a copy of ID and address for the response.

No personal information of the User is published, exchanged, transferred, or sold to third parties without the User's knowledge. Only the potential acquisition of MinePiece and its rights would allow the transmission of this information to the acquirer, who would be bound by the same data handling obligations. The site is not declared to the CNIL, as it does not collect personal data. Databases are protected by the law of July 1, 1998, implementing the directive 96/9 of March 11, 1996 on the legal protection of databases.

6. APPLICABLE LAW AND JURISDICTION

Any dispute related to the use of MinePiece’s Services is subject to French law. Exclusive jurisdiction is granted to the competent courts of Rennes.

These Terms of Use apply for an indefinite period. The contract takes effect upon the User’s first use of the Services.
